Charges Don’t Necessarily Mean Conviction

If you have been arrested for Driving Under the Influence (DUI) of alcohol or a controlled substance, the charges against you do not necessarily have to result in a conviction. There are many types of defenses or mitigating factors that can result in excluding evidence crucial to the prosecutor’s case or a dismissal of the charges against you.  Some of the most common defenses available in DUI cases can include:

•  Violation of Constitutional Rights

•  Chemical Testing Inaccuracies

•  Illegal Search

•  Failure to Give Miranda Warnings

•  Lack of Probable Cause to Pull Over

•  No Actual Physical Control

Women may have additional defenses, including a skewed body partition ratio, inflated reading from body temperature, and difficulty obtaining an accurate reading from a smaller lung.

The Sooner You Act The Better

You should seek legal representation as soon as possible after you have been arrested.  This is the timeframe when your constitutional rights are most at risk. This is the time when police officers try to get you to talk, and make self-incriminating statements.  Having an attorney with you following your arrest will put you on the right path to resolving the criminal matter in the most reasonable way possible.

Mary Bruehl is my lawyer. She has represented me twice and has taken the time to explain everything in layman's terms. For someone with such a gentle personality she is a tiger in the courtroom.
